Maternity leave and maternity leave pay in Hong Kong

Check notification requirements, leave arrangements and eligibility for pay.

Source checked · Maternity leave and pay conditions

Separate leave from pay

The Labour Department states that an employee under a continuous contract who gives notice of pregnancy and intended maternity leave after pregnancy is confirmed may qualify for 14 continuous weeks of maternity leave. Pay additionally requires at least 40 weeks under a continuous contract immediately before the scheduled leave starts and, if requested, a medical certificate stating the expected delivery date. With less than 40 weeks, qualifying leave may be unpaid; an employer may offer better terms.

Confirm notice and evidence

Ask how to notify your employer of pregnancy and the expected date of confinement, provide medical evidence and arrange the start of leave. Keep submitted documents and discuss practical arrangements with HR.

Ask about additional benefits

Check whether the employer offers leave or medical benefits above the statutory minimum and discuss your return. Contact the Labour Department with questions about eligibility, pay or protection.
