Annual leave in Hong Kong: what job seekers should check

Understand eligibility, leave arrangements and what to check when changing jobs.

Source checked · Statutory annual leave eligibility and days

Check eligibility

The Labour Department states that employees earn paid annual leave after each 12 months under a continuous contract: seven days for each of the first two years, eight for the third and nine for the fourth, increasing by one day a year to 14 days for the ninth year and above. For example, the statutory entitlement for the completed third year is eight days. Employers may offer more; check the official rules for your circumstances.

Separate different types of leave

Ask how the employer defines the leave year, approves requests and schedules leave. Check rest days, statutory holidays and any additional company holidays separately. Keep your balance and approval records.

Review your balance when leaving

Request a leave balance and final settlement statement from HR. Service length, the circumstances of departure and your contract can affect payment. Ask the Labour Department about your situation.
