Hong Kong resignation notice: check your contract and the law

Review probation, contract status and payment in lieu before planning your handover.

Read your contract first

Find the probation, termination notice and notification clauses. The required notice depends on the contract, employment stage and applicable law; do not assume everyone has one month. Confirm the final working date in writing.

Understand the legal framework

For a continuous contract, the Labour Department says no notice is required during the first month of probation. After that first month, the agreed notice applies but must be at least seven days; if the contract is silent, at least seven days is required. With no probation or after probation, an agreed notice must be at least seven days; if none is specified, at least one month is required. Different terms apply to non-continuous contracts; consult the official table for notice and payment in lieu.

Plan the handover

List current work, owners and file locations, and return equipment under company procedures. Check outstanding wages, leave and other applicable payments. Contact the Labour Department if there is a dispute.
